ASSAM MINERALS REGULATION AND DEALERS RULES, 2020

In the exercise of the power conferred by the section 23 C(1) and (2) of MMDR act, 1957 Government of Assam notifies “ The Assam Mineral Regulations and Dealers  Rule, 2020” on 18th of February, 2021.

AIM OF DEALERS RULES, 2020

  1. To regulate the possession, storage, trading and transport of minerals

 

  1. To check evasion of royalty, stopping of illegal mining and transportation in the state of Assam.

 

“DEALER” means:  

Any person who carries on the business of buying, storing, selling, supplying , trading, transporting, distributing or delivering for sale of minerals and mineral products and include the following:-

  1. Persons who buy and process mineral or mineral products for sale beyond any lease area.
  2. The end users consuming 500 MT or more of minerals per annum for commercial purpose.

 

WHO HAS TO REGISTER?

Mineral Dealers (Dealers of Coal, Limestone, Sillimanite, iron ore etc.) and any Commercial End User of Mineral consuming more than 500 MT and Includes: -

▪ Mineral Industries

▪ Distilleries

▪ Brick Kiln

▪ Coke Vatta.

▪ Tea Garden

▪ Mineral transporters

▪ Cement Factories etc.

Registration Process

Applicant shall apply in Form-A to the Director, Directorate of Geology and Mining with all relevant documents.

Documents Required

  1. Copy of Challan Generated from E-grass portal of amount Rs 20,000.00 ( 0853- nonferrous and metallurgical industry 800 other receipt 2279-Application fee for registration of Mineral Dealer license, Renewal of Dealers License, Issue of Transportation Challan)
  2. Copy of Pledge NSC of amount Rs.20,000.00
  3. Affidavit regarding Pending Criminal case.
  4. IT return
  5. Agreement of Deed of Partnership if any
  6. Trade License from Gaon Panchayat in Rural area/ Municipality Board in Urban area.
  7.  Copy of Jamabandi and Lease deed
  8. Certificate by Industry Department.(Not Mandatory)
  9. PAN card
  10.  GST Registration Certificate and Return
  11. Passport Size Photograph-3 Copy
  12.  Address proof (Voter ID and Aadhar Card)

 

Register to be maintain by registered Mineral Dealers:

Form F: Accounts of Minerals Procured, Stored, Stocked, Processed and dispatched to different destinations.

Form E: Accounts of Daily stock of Minerals for Processing Plants.

Form H: Accounts of Stocks of Minerals for Transporters.

Form M: Daily Account of Minerals for Procurement and Transportation.

Offend Against the

Norms of Dealers Rule:

 

A fine of Rs. 20000/- or imprisonment for a term which may extend to one year or with both.

▪ In the case of a continuing contravention, with an additional fine which may extend to Rs. 500/- per day during which such contravention continues after conviction for the first such contravention.

 

Buy/Sell mineral

without registration

 

A fine which may extend to Rs. 20,000/- (Rupees twenty thousand).

 

Illegal transportation

of minerals

 

Punishable with an imprisonment upto a term of one year or fine which may extend to Rs. 20,000/- or with both.

 

Intentionally Obstructing

the Competent Authority

to perform his/her duties

 

Punishable with an imprisonment for a term which may extend to 6 (six) months or fine which may extend Rs. 20,000/- (Rupees twenty thousand) or with both

 

Refusal to allow

Inspection of Site

 

Shall be liable to fine of rupees Rs. 10,000/-(Rupees ten thousand).

 

 

Not Maintaining Register

and Not Submitting

Return.

 

Shall be liable to a fine of Rs. 5000/-(Rupees five thousand

Maintaining False Register

and Submitting False Return

Shall be liable to a fine of Rs. 10,000/ -(Rupees ten thousand)

 

 

 

 

Terms and Conditions of Mineral Dealer License

  1. The Registration is non transferrable.
  2. This Registration is valid for a financial year only (From April to March)
  3. The registration is liable to be cancelled at any moment without assigning any reason thereof in the event of furnishing any wrong information/documents in the application submitted by him.
  4. The Dealer shall have to maintain proper accounts of name and address of person/lessee from whom mineral ore will be procured and sale of minerals with proof.
  5. When any competent officer/authorized officer have sufficient reason to believe that the information submitted by the dealer or end user is false or incorrect then he may seize the mineral along with register, records and challan.
  6. Any dispute whatever is subjected to competent court of Guwahati jurisdiction.
  7. Directorate of Geology and Mining will issue transportation challan to the registered Dealers on the basis of proper verification of documents regarding stock, Royalty payment, Source of Procurement etc.
  8. Registered Minerals Dealers will have to maintain accounts of Mineral Transportation with source of procurement and submit the same to the Directorate before issuing of transportation challan.
